Philadelphia Mayor, Michael Nutter, signed into law on December 15th, 2015, Bill 150815, expanding the city's Ban the Box ordinance. The ordinance becomes effective 90 days after the signing date of December 15th.
The new ordinance applies to employers having any employees within the City of Philadelphia. Previously, the ordinance applied to employers with ten or more employees.
Under the ordinance:
- Employers may only inquire into criminal history after an offer of employment has been made;
- Employers can only consider criminal convictions that have occurred within the last seven years;
- Employers must provide a special disclosure before obtaining criminal information; and
- If an offer of employment is rescinded, the applicant must be advised of the reason and be provided a copy of their report.
